The Thane Sessions court had rejected the bail application filed by a Kashimira resident, Yashi Rajiv Mehra (name changed), who was arrested under section 483 of BNSS Act , several POCSOA charges along with several other sections under the Immoral Traffic (Prevention) Act (PITA) charges. The court while rejecting the application held that the accused was involved in allegedly trafficking her own child and if released on bail, she is bound to commit similar offence with other young girls, thus rejecting the bail application.
The court in its orders held, “ The record indicates that when raid was effected, at that time, applicant and co-accused Shabinaz was accompanied by a minor victim girl aged 13 years 2 months. The facts itself shows that there is a direct involvement of the applicant in the commission of the offence. The mobile phone was seized from the possession of the applicant. The victim girl though daughter of applicant, she wanted to provide her for prostitution in the greed of money. The offence is serious. Applicant has engaged her own daughter for commission of offence. In such circumstances, if the applicant is released on bail, again she would involved in similar type of business and would supply the minor girls. Therefore, in my considered view, this is not fit case to release the applicant on bail, “the court held while rejecting the application.
As per the prosecution’s case the PSI Prakash Tuplondhe, attached to AHTC, Crime branch, Thane recieved a tip off of the accused allegedly trying to get the minor virgin girls in flesh trade. The police had laid a trap and thus the police were able to trap the accused. However surprisingly the accused had got her own 13 year old girl to get her involved in the flesh trade. The accused had confirmed that she was providing you d virgin girls, on the demand of the customers, where she was charging Rs 2 lakhs for them.
Mehra in her application said that she is innocent and that she is falsely implicated in the case. According to her victim is her daughter. The co-accused had called her saying that she wants to meet her in a hotel. And since her daughter was alone at home, therefore, she took the victim with her. “She has no concern with her daughter’s deal. Rather the co-accused is involved in dealing of girls with various customers. She makes target to the victims who are in need of money. She being a real mother of victim, she was not involved in such deal,” reads the bail application.
