The BKC (Bandra Kurla Complex) police have registered an FIR against Rupesh Soni, a diamond merchant, for allegedly cheating Rasikbhai Desai out of Rs.48.79 lakh. Soni took two diamonds from Rasikbhai Desai, who is also a diamond merchant, for the purpose of selling them. However, he neither sold the diamonds nor returned them to Desai. The police registered the case on March 5.
According to the FIR, the complainant, Rasikbhai Desai, 46, is a diamond merchant who lives in Malad East. He owns a private diamond trading company called Bandhan Exports. Sudhaben Desai, Hasmukhbhai Kakdia, and Pravinbhai Kakdia are partners in the business. His company has an office at BKC, Bharat Diamond Bourse in Bandra East, and a branch in Surat, where diamonds are cut and polished.
His friend Gianchand Bamba is also a diamond merchant. Since they had known each other for the past fifteen years and had often traded diamonds, Desai trusted Bamba immensely. Bamba suffered heavy losses in business, so he now works as a diamond broker.
In October last year, Bamba visited Desai’s office with Rupesh Soni, a diamond merchant. Bamba introduced Soni and mentioned that he owned a company called L Kanhaiyalal Jewels. He claimed that Soni had reliable customers who regularly bought diamonds, suggesting that dealing with him would be beneficial.
Trusting this information, Desai and his partners started dealing with Soni. At Soni’s request, they gave him two diamonds, totaling 90.93 carats and worth Rs. 48.79 lakh, on October 8, 2024. Soni had promised to pay for these diamonds within seven days and return any unsold diamonds to Desai. However, even after several days, he neither returned the diamonds nor made the payment. Desai repeatedly tried to contact Soni, but his mobile phone was switched off. Despite multiple attempts, he could not be reached.
Realising that Soni had misappropriated the diamonds taken on credit, Desai filed a complaint with the BKC police. The police registered the case under sections 316(5) (criminal breach of trust) and 318(4) (cheating) of the Bharatiya Nyaya Sanhita.ReplyReply allForwardAdd reaction
